Nicole Andreson elected to the American Law Institute

We are pleased to announce that Nicole Andreson has been elected to The American Law Institute (ALI). Ms. Andreson is one of 72 newly elected judges, lawyers, and law professors from around the country.  ALI is the leading independent organization in the United States producing scholarly work to clarify, modernize, and improve the law.

Ms. Andreson’s practice is focused on the representation of physicians and hospitals in professional malpractice actions in both federal and state courts.  Immediately prior to joining the firm, Ms. Andreson served as a Deputy State’s Attorney for the Chittenden County State’s Attorneys’ Office.  During her tenure at the State’s Attorneys’ Office, Ms. Andreson prosecuted sexual assaults and crimes against children. Prior to prosecuting, Ms. Andreson worked as an Assistant Attorney General for the Vermont Attorney General’s Office.

Two Dinse attorneys recognized as litigation stars in Benchmark Litigation 2016

We are pleased to announce that Ritchie E. Berger and Karen McAndrew are featured in Benchmark Litigation 2016 as Litigation Stars for their outstanding work in litigation. The results of Benchmark Litigation stem from the culmination of a six-month research period where researchers conduct extensive interviews with litigators and their clients to identify the leading litigators and firms. During these interviews, researchers examine recent casework handled by law firms and ask individual litigators to offer their professional opinions on peers.

Mr. Berger is head of the Litigation Section of the firm and is considered one of Vermont’s premier trial lawyers.  He concentrates on the defense of complex civil litigation throughout Vermont and New England. He is a Fellow and Regent of the American College of Trial Lawyers, and a member of the American Board of Trial Advocates, Past-President of Vermont Chapter.

Ms. McAndrew is one of Vermont’s leading trial lawyers.   She headed the firm’s litigation practice for many years, and was named a Fellow of the American College of Trial Lawyers in 1997.  She has successfully tried many complex civil cases in state and federal courts, and handled numerous appeals in the Vermont Supreme Court and the Second Circuit Court of Appeals.  She has a particular concentration in higher education law.

David Gurtman receives Vermont Business Magazine’s Rising Stars Recognition award

We are pleased to announce that David Gurtman has received Vermont Business Magazine’s Rising Stars recognition award. He is among 40 award winners under the age of 40. Award recipients were selected by a panel of judges for their commitment to business growth, professional excellence and involvement in their communities.

David Gurtman joined the firm in 2006. Mr. Gurtman practices in the areas of business transactions, non-profit organizations and commercial real estate. Mr. Gurtman advises Vermont companies on legal issues impacting their business, including structuring and closing strategic acquisitions and dispositions, capital raising and financing transactions, the formation of corporations, limited liability companies and partnerships, supply and distribution agreements, and tax planning.  His clients range from entrepreneurial startups to mature companies with operations within and outside of Vermont.  He has also been involved in some of the largest renewable energy projects in the state and provides state and federal tax advice related to such projects.  His practice also includes advising tax exempt organizations in entity organization and formation, recognition of their tax-exempt status and corporate governance matters including drafting bylaws and operating policies. Prior to joining Dinse, he served as a law clerk for the Vermont trial courts in Chittenden and Addison Counties.  He currently serves on the Boards of CarShareVT, Chittenden County Bar Association, Leadership Champlain, and is member of the Vermont Business Roundtable.

Austin D. Hart
Real Estate Law

Mr. Hart has represented clients in all phases of real estate transactions, including acquisition, permitting, development, finance, operation, leasing, and sale. He has advised clients with different types of real estate projects, including commercial office buildings, retail shopping centers, institutional campuses, and a planned recreational/residential community. He has served as counsel to common interest community owner associations, including a large mixed use resort association at a major Vermont ski area. A substantial portion of his practice focuses on the unique issues faced by colleges and hospitals in the ownership, operation, and expansion of their campuses, including property tax exemption laws. Mr. Hart was elected in 2015 as a Fellow of the American College of Real Estate Lawyers.

Dinse Announces New Managing Partner

Dinse, Knapp & McAndrew announces that Jeff McMahan has been elected as its President and Managing Partner to succeed Brian Murphy. Regarding the transition, Brian said, “The firm is fortunate to have many outstanding leaders and the unanimous selection of Jeff as our new President is a superb choice. His leadership skills are excellent, his keen business sense is a valuable asset, and his vision for the firm’s future is very exciting.”

Mr. McMahan is a corporate and intellectual property lawyer, advising businesses on issues related to formation, mergers and acquisitions, raising capital, technology licensing, trademarks and copyrights. Mr. McMahan’s clients range from entrepreneurial start-ups to publicly-held companies. He has particular experience representing software vendors and purchasers in the negotiation of computer system implementation, license and support agreements. Mr. McMahan also advises clients on the selection of trademarks and assists with the registration of their trademarks with the U.S. Patent and Trademark Office.

Mr. McMahan’s practice also focuses on securities matters. He has assisted both privately-held and publicly traded companies with the private placement of stock and works extensively with higher education and healthcare clients in connection with their tax-exempt bonds.

Mr. McMahan said, “During his five years as Managing Partner, Brian has done a great job nurturing our firm’s collaborative culture – which results in a high level of services to our clients. Nolan to Co-Present Four New Training Programs Offered by United Educators in 2015

Program Designed to Prevent Violence and Address Title IX and VAWA Compliance

Bethesda, MD (May 18, 2015) — New training programs designed to help institutions develop a cross-disciplinary approach to prevent and respond to sexual violence, intimate partner violence, and stalking are being offered by United Educators (UE), the nation’s leading provider of risk management solutions for higher education. Unique to this training is the emphasis on use of campus threat assessment teams to address these offenses. The “Title IX, VAWA, and Threat Assessment” trainings will be offered in four cities and feature an interactive format to help institutions comply with Title IX and VAWA training requirements.

“Keeping victims safe while preventing and responding to sexual assault, stalking, dating or domestic violence requires a coordinated approach involving administrators representing multiple functions,” said Marisa Randazzo, PhD, Managing Partner, SIGMA Threat Management Associates and one of the two presenters.

As an international expert on threat assessment, targeted violence, and violence prevention, Dr. Randazzo will conduct the training with Jeffrey Nolan, a partner with Dinse, Knapp & McAndrew, P.C. Nolan’s firm represents institutions of higher education, advising them on issues and assisting with the development and implementation of policies and training programs.

“Risks are diffused and reports are investigated more effectively when threat assessment teams can work closely with Title IX coordinators, student affairs, human resources, campus safety, and legal affairs to evaluate any ongoing threats and implement safety plans where necessary,” said Randazzo.

Nolan said, “This will help satisfy Title IX coordinator training requirements provided in the April 24, 2015, ‘Dear Colleague’ letter as well as VAWA training requirements for officials who conduct disciplinary hearings. Participants will leave with actionable plans and a better understanding of the perspectives and responsibilities of other team members. The overall impact will be a safer campus environment.”

This unique approach will help administrators prevent and resolve incidents of sexual violence and assault on college campuses. “Administrators need multiple tools to assess and address the complex issues they face,” said Constance Neary, UE’s vice president for risk management. “Attending training as a multidisciplinary team enables administrators to be better equipped to prevent and resolve incidents of sexual violence.”

Training sessions are scheduled for Baltimore on June 18-19; Boston, July 28-29; Chicago, Oct. 8-9; and Atlanta, Nov. 3-4.

Nolan presents several sessions at UVM Conference

Jeff Nolan of Dinse’s Higher Education Practice Group presented three sessions at the University of Vermont’s national Legal Issues in Higher Education Conference in October, 2014. Jeff co-presented the keynote update on recent developments in higher education law, co-presented a session on the Violence Against Women Reauthorization Act (“VAWA”) and Title IX, and co-presented a session on the relationship between VAWA obligations to respond to dating violence, domestic violence and stalking and the work of campus threat assessment teams.
